B. Clark (exhibit D). It may be well to call attention to the fact that the above exhibit of receipts and disbursements for the two years 1890-92 shows that the Re­gents have kept the expenses of the University within the income. As has been said in former reports: "At no time since the organization of the University has there been a deficit to report to the Legislatme, and in the future.no deficit shall occur unless there is an unforeseen shrinkage in some expected source of revenue." II. PRESENT CONDITION O:F MAIN UNIVERSITY. A. PERMANENT ENDOWMENT. The permanent endowment of the Main University consists of (1) lands, (2) land notes, (3) State bonds. ( 1) Lands.-The classification, location, and condition of the lands given to the University at various times were fully set forth in the Third Biennial Report of the Regents (pp. 6-10). In brief, the landed endowment of the University consists (a) of the original fifty leagues granted by the Republic of Texas; (b) of the million acres granted by the Constitution of 1876; ( c) of the million acres appropriated by the Legislature (act approved April IO, 1883). (a) The original fifty leagues.-Most of this land has been sold and the proceeds converted into bonds and land notes. The disputed titles in McLennan county, referred to in Third Biennial Report, have been REPORT OF REGENTS. 7 cleared by compromise, the University gaining one-half (about 7,000 acres) of the land in controversy. The conflict in Grayson county, involving 8022! acres, is still unsettled so far as the Regents are in­formed. To quote from the Third Biennial Report the case is as follows: "In order to make out the full complement of fifty leagues, 8022! aci;es were located and surveyed in Grayson county and reported to the Land Office· as .University lands. When these lands were sold, however, the proceeds were credited to the general revenue and not to the University fund." It is hoped that this case and others of similar character that might be mentioned will be equitably considered by the Legislature. Occasional sales are made of such of the original fifty leagues as are not in conflict. Since the last Biennial Report of the Regents, December, 1890, 3033 5-12 acres have been sold as per statement of treasurer (ex­hibit E). This statement not only shows the number of acres sold, but also the location of the lands, the name of the purchaser, and the price paid per acre. (b). The million acn-es granted by the Constitution of 1876, and (c) the millwn acres appropriat,ed by the Legislature of 1883.-But little of this land has been sold, as it lies in the western part of the State, mainly in Tom Green (as originally bounded), Andrews, Martin and El Paso counties, and, therefore, is not in demand for actual settlement. Such as has been sold is stated in the several reports of Treasurer in the Third and Fourth Biennial Reports of Regents. In the Fourth Biennial Report of Regents ( 1890) the number of acres of these lands leased up to that time was given as 352,160 acres at 3 cents per acre. In statement received from Treasurer June 16, 1891, it is re­ ported that 567 ,000 acres were under lease (exhibit F). In statement re­ ceived from Treasurer dated May 19, 1892, it is reported that 662,800 acres we1·e under lease (exhibit G). The number of acres reported leased September 13, 1892, is 675,680 (exhibit H). The number of acres re­ ported December 10, 1892, (last statement received from Treasurer) is 685,280 (exhibit I). The date of each lease, the name of lessee, the county in which the tract is situated, the number of acres, the length of the lease and the yearly payment, are given in each of these statements. The en­ tire condition of the University lands leased from December, 1890, to December, 1892, is therefore given in these successive reports from the Treasurer. Out of the two million acres there are at present, as has been stated, 685,280 acres under lease at 3 cents per acre. From this the University derives an estimated annual revenue of $20,558.40. This revenue is characterized as "estimated," because at any time, for non­ payment of annual rental, it may be reduced by cancellation of the lease. These cancellations during the last two years have amounted to 165,920 acres. If in the next two years the cancellations should be in excess of the number of acres leased, the annual income from this source would be less than $20,558.40. The annual revenue, therefore, from the lease of lands is uncertain, and can not be implicitly relied on. (2) Land Not.es.-These notes represent the unpaid balances due on land sales. They amount in the aggregate to $61, 714. 72 (exhibit K), against $64,606.31, reported 1890. The difference, $2,891.59, has been invested in State bonds. Of these notes $13,996.53 bear 10 per cent in­terest, yielding an estimated income of $1,399.65. The remainder, •47,718.19, bear 5 per cent interest, yielding an income of $2,385.90. UNIVERSITY OF TEXAS. The total amount received from the payments on these notes since No­vember 30, 1890, is $9692.08-principal $3014.12, interest $6677.96 (exhibit J). (3) Bonds.-The total amount of bonds held in trust by the State for the University in 1890, as given in Fourth Biennial Report of Regents, page 5, was $569,340, and the annual interest on same was given as $34,268.60. In statement of Treasurer, dated December 1, 1892, here­with submitted (exhibit K), the total amount of bonds at present is $571,340, and the annual interest on same is $34,368.60. The difference between the total rendered in 1890 and the present total (1892), $2000, and the interest rendered in 1890 and the present interest (1892), $100, is due to the fact that the Comptroller has purchased for the University $2000 of 5 per cent bonds since November 12, 1890. The Regents beg leave to call your Excellency's attention in this con­nection to a matter of considerable importance to the University. In the Fourth Biennial Report, page 5, it was said: "Attention is called to the fact that some of the bonds mentioned in the statement of Comptroller have already matured, to-wit, $2000 at 6 per cent due .January, 1890; anrl attention is again called to the fact that $12,000 at 6 per cent will fall due March, 1892, and $138,000 at 7 per cent April, 1892. It is respectfully requested that, if necessary, such legislation be recommended to the Legislature as will secure the University against loss, either from a temporary suspension of interest or from a forced reinvestment at a lower rate per cent. The present bonds might be continued indefinitely, or a new single bond might be issued at the same rate and held in trust by the State for the University." What was anticipated in the report of 1890 has taken place. The in­terest due on $2000 at 6 per cent, which matured January, 1890-, and on $12,000 at 6 per cent, which matured March, 1892, and on $138,000 at 7 per cent, which matured in April, 1892, has not been paid. The atten­tion of the Comptroller having been called to the difference in the amount of interest from bonds reported in 1892 and in 1891, the follow­ing communication was received: AUS'l'IX, TEXAS, Dec. 27, 1892. The attention of ihe Legislature has been called to this matter. Hespectfully, JOIDI" D. McCALL, Comptroller. Reference is hereby made to the Report of the Comptroller to Lhe Legis­lature for the full details in regard to this matter, and the request is made that appropriations covering the full amount of interest due be made by the Twenty-third Legislature, and further that manuscript bonds covering the full amount of the matured bonds be issued at the same rate per cent interest, to wit, $2000 at 6 per cent, i12,ooo at 6 per cent, and $138,000 at 7 per cent. Any diminution of the rate per cent would lessen the income from a fund which the State holds in trust for REPORT OF REGENTS. the University, and on which it mainly relies for support and main­tenance. A failure in any of these suppositions will proportionately reduce the above estimate. To the total from endowment may be added the annual fees from stu­dents. Up to date for the present session (1892-93) these amount to $5890. The increase in the total income is $11,836.96. This increase is due mainly to the lease of lands and the fees of students. B. THE FACULTY. The Main University at Austin is composed at present of the Academic and Law Departments. These two departments occupy the same build­ing and are under one organization, a chairman of the Faculty being annually elected by the Academic and Law professors. The Law Faculty -0onsists of two full professors. The Academic Faculty consists at pres­ent of six full professors, five associate professors, three adjunct pro­fessors, one assistant professor, one instructor, four tutors, and three fellows, in all twenty-three. Full professors are appointed without ex­press limitation of time; associate professors for five years; adjunct and assistant professors for three years; instructors, tutors and fellows are ap­pointed for one year. Full professors have charge of distinct schools; associate and adjunct professors may have charge of distinct &chools; and assistant professors, instructors, tutors and fellows are assigned to schools presided over by officers of higher rank. The chairs filled and the sub­jects taught by each of these are fully set forth in exhibit L. This ex­hibit also shows the Faculty and other officers of the Medical Department referred to under the head of that department. Besides the above officers of instruction the Main University at Austin has one lady assistant, and one proctor, who is also librarian and secretary of the Faculty. Counting the Law Department and the Academic Department as one organization, the Main University has twenty-seven officers of instrnction and govern­ment. In the last Biennial Report the total number of officers of in­struction and government was given as nineteen. There has been, there­fore, an increase of eight within two years. This increase has been entirely in the Academic Department, and consists of the following in­structors: UNIVERSITY OF TEXAS. Of these five were allowed a re-examination January 1, 1892, and four succeeded in passing on the second trial. In order to prevent as far as possible the disappointment of a rejection at Austin, and the expense of perhaps a fruitless journey. the Faculty have recognized the various Auxiliary Schools throughout the State as points of local examinations for entrance into the University. Questions under seal are sent to the Principals of these Schools, and, upon an appointed day, these questions are opened in the presence of the applicants, the ex­amination is held and the papers are sent under seal to the Faculty. As soon as possible the papers of the applicants are read and estimated, and the results are sent to the Principals of the Schools.
